 Anti-dumping (“AD”) frameworks are a trade remedy measure aimed at protecting domestic industries, and are internationally recognized under the WTO Agreements. They make it possible to impose additional duties (anti-dumping duties) on products imported from foreign countries, when it is judged that the product is being sold at a price that is unfairly lower than the price it would normally be sold at in the exporting country (“dumping price”), and that domestic industries are being harmed as a result.

 

 In Japan, a mechanism is in place where the Ministry of Finance (MOF) and Ministry of Economy, Trade and Industry (METI) will jointly investigate and impose anti-dumping duties where necessary, pursuant to Article 8 of the Customs Tariff Act and related Cabinet Orders, etc. Private-sector companies and industry bodies are mainly responsible for applications, in principle, and applications must satisfy the three conditions of “existence of dumping,” “substantive harm to domestic industries,” and “cause-and-effect relationship between these factors.”

 

 Applicants must prepare proof that dumping is occurring, data to back up claims of harm, and a “written application for duties” that demonstrates the cause-and-effect relationship between these factors. The investigating authorities will examine the accuracy and reasonableness of the materials submitted, complete an investigation within one year (up to 18 months at most), in principle, and make a final decision on the case. In principle, anti-dumping duties are imposed for five years, but may be extended.
